Contract/Purchase Agreement
For the Weimaraner Puppy as described here:

The Seller guarantees this dog to be in good health on the date of sale. The dew claws have been removed and the tail docked.
SELLERS have in good faith, through this agreement, attempted to place this puppy in a suitable home based on personal interviews with the BUYERS and observation, testing and evaluation of the puppy.
It is recommended that the purchaser arrange for a veterinarian examination of the pup within the first three days after the date of physical transfer of the pup for a health checkup. Should the veterinarian determine this dog to be in ill health, the cause of which is clearly attributable to the Seller, this dog may, upon presentation of a written diagnosis from said veterinarian, be returned for a refund of purchase price. Upon receipt of the puppy, the Seller shall be obligated to replace the puppy with one of equal quality from the current litter or future litter of the above mentioned sire and dam, and further performance under this contract shall be null and void. The Buyer may also elect to accept a puppy from a current or future litter with other parents if the wait time will diminish greatly. If this dog should develop a major communicable disease (i.e. Distemper, Parvo etc.) within seven days from the date of transfer, the Seller must be notified immediately and will provide instructions for refund or replacement. Any veterinarian’s diagnosis shall be subject to confirmation by a veterinarian chosen and paid for by Seller. Should said veterinarian not concur with the diagnosis of Buyer’s veterinarian, the matter shall be presented to a third veterinarian (cost shared between Buyer and Seller) for final diagnosis.
Any condition that is minor, correctable, or a breed related minor condition is not covered. Conditions which could go away, or are considered to be a condition which a puppy will likely grow out of is not covered. The conditions not covered include but are not limited to: umbilical hernia, any disease the puppy has been vaccinated against or is native to the environment, cuts, injuries, any internal parasite, skin disorders such as mange or allergies, or any other minor condition. Minor conditions are too numerous to completely cover in this document. Any minor condition may be discussed with the breeder for consideration. Hip dysplasia is covered for two years from date of birth. Types of hip dysplasia not covered are nutritional and environmental dysplasia.
Vaccinations: The Weimaraner Club of America has established a special protocol for vaccinating Weimaraner puppies due to immuno-deficiency problems in this breed. BUYERS agree to have their veterinarian administer a series of vaccinations for parvo/distemper, rabies and other recommended vaccinations, strictly following the treatment schedule furnished with the puppy and attached. If the series is not continued and strictly administered using the protocol as outlined, the health guarantee described above shall become null and void.
Seller does not assume responsibility for any other veterinary bills or other expenses incurred by the purchaser on behalf of the dog after the dog has left the kennel.
The Buyer agrees to maintain preventative health care of the puppy including, but not limited to: inoculations, internal as well as external parasites, heartworm preventative medication. In the event a Buyer exercises return rights under one year health guarantee, all documentation that the above maintenance has been performed must be provided to Seller. If the buyer does not provide such proof that every step was taken to assure the good health of the puppy, no refund or replacement puppy will be given.
The Buyer agrees to maintain preventative care of the puppy in regards to hip dysplasia, such as proper nutrition, proper exercise, and preventing stress injuries (i.e. not allowing the puppy to jump from heights taller than itself at the shoulder, no forced exercise such as running, until at least 12 months of age.) The buyer further understands that this puppy is not being sold with a guarantee against Canine Hip Dysplasia, as that condition can be caused by environmental situations that are not within the control of the seller once buyer assumes possession.
The stud’s hips have been rated 90th percentile by PennHip Evaluation and the bitch’s hips have been rated OFA Good. Should the dog develop crippling hip dysplasia and/or be ex-rayed and OFA rated moderate or sever before reaching twenty eight months of age, (with verification of the hip condition signed by a veterinarian provided) then PM Weimaraners will replace the dog as soon as one becomes available – or buyer has option to retain ownership of said dog.
BUYERS agree to use the name “PM’s” as a prefix on the AKC registration papers.
This puppy has been sold as a pet/companion dog; PM Weimaraners does not sell brood bitches or stud dogs (unless otherwise arranged). They are sold with the AKC Limited Registration, which states this dog may be registered, but any offspring resulting from mating will not be.
If the puppy is being sold with limited registration, the Buyer agrees to have the puppy spayed/neutered by the time it is of at least 14 months of age and provide Seller with verification of such.
Upon Initialing Registration A or B, I understand this is the type of registration the puppy will have from the AKC. Limited registration can only be changed to AKC Full registration if an AKC hunt (NAVHDA Natural Ability, Utility Prep etc., test) or Conformation title is attained by said dog/bitch and all health tests performed and provided to PM Weimaraners. Hips/Elbows/CERF/Cardiac.
___A. Limited AKC Registration, never to be used for breeding purposes, and to be spayed or neutered at the appropriate age. Limited registration restricts any placement in conformation shows or breeding. It does allow any and all placements into hunt and field tests, earthdog, tracking, agility, companion dog etc.The health guarantee does not guarantee against belly button hernia, cryptorchidism, dew claw re-growth or under or over-bite with this type of registration. With this type of registration proof of spay or neuter does need to be provided from a certified veterinarian.
___B. Full AKC Registration. Full registration allows all conformation shows, breeding (after all health test results have been provided to breeder along with show results) field test etc., Full registrations are subject to co-ownership with the kennel. We reserve the right to refuse a full registration on any puppy. We reserve the right to choose who will be placed on a co-ownership with full AKC registration. The breeder does not guarantee that the pup purchased will be successful in a breeding/show/hunting program. The health guarantee DOES guarantee against belly button hernia, dew claws re-growth and over or under-bite with this type of registration.
Medical records have been provided to me and I understand all of these all of these terms for the sale of the puppy. By signing below, I agree to these terms and conditions. I also understand that theis document shall be enforceable in any court of law and any and all legal ramifications will take place in the state of Montana. This document shall be kept, with my signature, address, and phone number, on file with PM Weimaraners and a copy has been provided to me.

The buyer agrees that this animal will not be used for breeding purposes until it is at least 24 months of age to another Weimaraner (which should meet the following criteria as well) either registered with AKC or other certified dog registry (ADRK,UKC, CKC) and preferably after it has passed the following and has proof thereof:
* X-ray and evaluation of hips and elbows by certified veterinarian.
* Current negative Brucellosis report from vet
* Current CERF Certificate
* All inoculations and worming up to date
BUYERS acknowledge that the SELLER has a vested interest in the puppy throughout its lifetime and SELLER has to the best of their ability, placed the puppy in a home that matches the BUYERS needs and requirements with the Weimaraner breed and the temperament of this puppy. In the event the BUYER is unable or unwilling to meet the terms and conditions of this Agreement the puppy must be returned to the SELLER. The puppy may not be sold, placed or traded to another owner nor placed in any shelter or rescue organization. In the event BUYERS no longer wish to own or care for the puppy, IT MUST BE RETURNED TO THE SELLER IMMEDIATELY. There will be no refund of any monies paid.
The buyer agrees that the Seller may repossess the animal upon evidence of neglect and/or abuse at no expense to the Seller, and no refund of any monies will be given to the abusive Buyer.
This transaction and Agreement shall be governed by the laws of the State of Montana. BUYERS and SELLER stipulates that any legal dispute or claim arising out of this Agreement shall be exclusively presented in a Court of competent jurisdiction in the State of Montana.
The Buyer agrees that the puppy will NOT be left alone in backyard or kennel only. The Buyer agrees that the puppy will reside inside the home of the Buyer, and not be chained or “tied out”. This animal is sold with the understanding that it was to go to select homes, socialized properly, and become a member of the family.
This Agreement is made and signed by both parties to insure the well being and protection of this animal. If any part of this Agreement is breached, the Seller is released from any further obligations hereunder.
Should the Seller need to seek legal action against the Buyer for violations of this Agreement, the Buyer will assume any and all attorney costs and court
